Local Board Information
Pursuant to Section 10 of PEBA, a public employer other than the state may, with the approval of the PELRB, create by ordinance, resolution or charter amendment a local board that is similar to the PELRB. Once created and approved, the local board shall assume the duties and responsibilities of the PELRB. The local board shall follow all procedures and provision of PEBA unless otherwise approved by the PELRB.
Unless a variance is specifically requested, see NMAC 184.108.40.206, public employers should use one of the following model templates to create a local board:
- Model Ordinance for public employers other than public schools; or
- Model Resolution for public schools (identical to the Model Ordinance except that public school probationary employees are included in the bargaining unit and the impact of professional and instructional decisions is a mandatory subject of bargaining).
